BELGIAN SUPERVISORY AUTHORITY: the APD approves its first national code of conduct

The code of conduct of the National Chamber of Notaries

This code specifies some disposals of the GDPR and adapt them to the peculiarity of the processing operations carried out by notaries. In its case, main disposals interested are:

  • The designation of a data protection officer
  • Measures that need to the adopted for the personal data processing security
  • Measures that the notary shall adopt for employees in order to sensibilize them to the personal data protection and to precautions that shall be taken when they have to process personal data;
  • The information right of data subjects.

Further information shall be found out into the Decision 04/2021 of the General Secretary.

The National Chamber of the Notaries will be responsible of the control of these rules, except inspection powers and sanction ones of the APD. Any supervisory body has been provided in this case, because the Code covers the activities of notaries as data controller in a public office. The APD remembers, anyway, that when a code of conduct covers a different processing from the public sector, it shall be designed an independent supervisory body.

The code of conduct: an essential instrument of the GDPR

The APD encourages the development of code of conduct. This instrument provided by the GDPR permits to establish good practices of compliance form at sector level and it is beneficial both for data controller and for citizens. The authority is at disposal of data subjects in order to reply to their requests and support them in the development of these codes.

Anyway, the APD wants to specify that the submission to a code of conduct approved by the APD does not make a compliance attestation of processing carried out by members of the code of conduct.
