DANISH SUPERVISORY AUTHORITY: Don’t forget to use the new Standard Contractual Clauses

From September 27 will be applied the new Standard Contractual Clauses of the European Commission on transfers towards third countries.

On the 4th of June 2021, the European Commission has adopted a series of new Standard Contractual Clauses for transfers towards third countries.

At the same time, the European Commission has decided to repeal the previous decision and the decision on the adoption of standard rules pursuant to the Directive 95/46/CE, with effect from September 27.

This means that, as a general rule, it is not possible to use Standard Contractual Clauses adopted as a part of the personal data protection directive for the transfers of personal data from that date.

Anyway, agreements on personal data transfers which are using standard rules adopted as a part of the personal data protection directive and ended before September 27, shall still be applied until the 27th of December 2022 provided that the processing covered by the agreement remains unchanged and that the application of these Standard Contractual Clauses guarantee that the transfers of personal data is submitted to necessary guarantees.
