DANISH SUPERVISORY AUTHORITY: it has been approved the code of conduct of the Ministry of the ecclesiastical affairs

A new code of conduct prepared by the Ministry of the ecclesiastical affairs and by the National Association of Parish Councils has been now approved by the Danish Data Protection Authority.

The Ministry of the Ecclesiastical affairs, in cooperation with the National Association o Parish Councils has prepared a code of conduct on the personal data processing in the field of the protection and parish councils in Denmark.

A code of conduct aims to establish guidelines and specific procedures for a series of sectors in order to guarantee the legal processing of personal data for the parish council as a data controller.

The code shall be a useful and efficient instrument for the personal data processing in relation with the protection into the parish council, to a district council which has joined to the code are, for example, provided some specific guidelines on how the council have to behave, in connection with the fulfilment of the duty to inform and the recollection of information in relation to situations listed into the code.

The code of conduct has been developed in order to specify the application and facilitate the compliance of the personal data protection in the following areas:

  1. Responsibility of data
  2. General principles of the processing
  3. Basis for the processing
  4. Usage of the consent
  5. The duty to provide information
  6. Stock-taking
  7. Secure storage and secure communication

The submission to the code of conduct is voluntary and the code is applicable to district councils which have formally joined. The adhesion and the compliance of the Code of Conduct is applicable in its conjunction and does not exonerate the districts councils from the compliance of personal data protection legislation.

The submission to the code does not undermine the competence of the Stata Data Inspectorate as supervisory Authority.

By the General Data Protection Regulation, it results that the code of conduct approved shall be published on the website of the Danish Data Protection Authority pursuant to the article 40, paragraph 1, of the GDPR.

The Danish Data Protection Authority shares that code to the European Data Protection Board, which registers the code of conduct and it makes it available, pursuant to the article 40, paragraph 1 of the GDPR.
