FRENCH SUPERVISORY AUTHORITY: reject cookies shall be easily as accept them: the CNIL implement a second series of formal warnings

After about twenty formal warnings issued in May 2021, which have led to the compliance, the CNIL president has issued formal warnings to about forty other organizations which still today do not permit internet users to reject cookies so easily as accept them. The CNIL will still carry on its controls and, if it is necessary, will adopt new corrective measures against organizations which are not in compliance.

As announced a months ago, the CNIL is pursuing its global strategy in order to guarantee the compliance by those one who are using cookies.

At the end of May, the CNIL president has send about twenty formal warnings which have permitted interested organizations to correct their bad practices.

Anyway, some organizations are not in compliance with the legislation on cookies. This situation is not acceptable.

Consequently, the CNIL president has decided to adopt new formal warnings against forty organizations with bad practices that are not in compliance. These last ones have an expiring date in order to get in compliance which is the 6th of September 2021,

The following are the companies particular interested by these warnings:

  • Four big platforms of the digital economy
  • Six big producers of hardware and software
  • Six big companies which sell consumer goods online
  • Two great actors in the online tourism
  • Three rental car companies
  • Three big actors of the bank sector
  • Two public services online
  • An energetical company

This new campaign completes those procedures in front of the Select Committee of the CNIL (the body responsible for the sanction imposition) which can bring sanctions until the 2% of the turnover.

The political control of the CNIL is long-term. Other verification campaigns and corrective measures will be carried out in autumn in order to guarantee the respect of the privacy of French internet users. The purpose if to guarantee the effectiveness of the campaign carried out by the CNIL in the last two years, which has led to the adoption of guidelines and a recommendation on the 1st of October 2020.
