FRENCH SUPERVISORY AUTHORITY: the Luxembourg Personal Data Protection Authority has infringed to Amazon Europe Core a sanction of 746 million euro

On the 16th of July 2021, the National Commission for Personal Data Protection of Luxembourg, CNPD, has infringed to the company Amazon Europe Core of a sanction with the amount of 760.000.000 EUR).

This decision has been originated from a collective complaint which has been addressed to the CNIL by the Association La Quadrature du Net (LQDN).

The implementation of the procedures of cooperation among authorities instituted by the GDPR, the CNPD was responsible in processing this dossier, because the company Amazon Europe Core was established on its territory.

The CNIL has cooperated with the CNPD during the whole proceeding, in the field of control and the analysis of proofs obtained, then, also during the exam of the decisions project in the filed of the proceeding of the one-stop-shop.

The decision has not been published din this phase in application of the Luxembourg legislation which prevents that the advertising shall happen only once that all the appeal possibilities have been reduced. Anyway, a lot of ways of communication have talked about it. In addition, the complainant, the association La Quadrature du Net (LQDN), have been informed of this decision in compliance to what is planned by the GPDR.

This is not the first sanction against Amazon because the CNIL has sanctioned Amazon and Google for the lack of the respect of the legislation on cookies on the last December, respective for 35 million euros and 100 million euros.

This decision of the CNPD has an unparallel portability and it marks a turning point in the implementation of the GDPR and in the protection of rights of European citizens.
