On the last year, the State Data Inspectorate has examined the assessment of guideline IB in the high secondary school. Many people have the experience to obtain marks based on other student’s performances. The Norwegian Data Protection Authority has announced a decision which has bring IB to make some changes. The case is now closed.
It closes the case IB
Even if the notification of decisions of the State Data Inspectorate brings some changes and that a lot of students have increased their level, there also many students that are not happy of these changes. A lot of them have contacted the Norwegian Data Protection Authority.
The IB organizations considers that the State Inspectorate has not the competencies in order to pursuit the case. According to the organization, they have their own registered office in the United Kingdom at the time of the first assessment. United Kingdom was part of the European Economic Area. As a general provision, the Norwegian Data Protection Authority can not take any decisions against other companies in EEA countries.
The Norwegian Data Protection Authority has ended that the main establishment of the IB organization was in the United Kingdom, as they affirmed. Based on this, the Authority has closed the case.
About the case
During summer 2020, the Data Inspectorate has started an inspection of the algorithm of the IB organization after some news on students that have received lower marks. The investigations reveled that in order to compensate the cancellation of the exam, the IB organization has established an algorithm that, among the other things, was using historic results of the school as a decisional basis.
The State Inspectorate has considered that this was in contrast with basic principles of the GDPR. It has notified the decision that the organization shall fix new marks. The IB organization was not in agreement with the assessment, but it has chosen to change the classification.
