The State Data Inspectorate has asked a compensation of 100.000 NOK to Waxing Palace AS. The company is managing a growing salon and they have controlled with video cameras the reception area by breaching the privacy ordinance.
Sanction to Waxing Palace AS
The privacy Law asks that each personal data processing has a legal basis. After having investigated on a complaint on the usage of a surveillance video camera in premises of the salon, the assessment of the State Data Inspectorate is that the company has not a legal basis for the video surveillance. The Inspectorate has concluded that the company has not provided sufficient information on the control.
Illegal video surveillance
There are strict rules for situations in which it is permitted control by using a video camera. This is particularly true on the working place. The principle is that the personal data processing shall be lawful and open and it is fundamental. Breaches of these principles are serious.
You shall always be open with people you are registering personal information. A good information shall, among other things, guarantee that there are not doubts on which area is captured by the video camera. The clearest rule is that anyone shall be caught of being controlled by the video camera.
It replies after the payment
The Data Controller considers that the case is so serious that it is necessary to impose a sanction.
People have the privacy right, and this is particularly true on the working place. The video surveillance shall be stressful for employees.
In this case, the Authority has underlined that the illegal video surveillance affects both employees and client. The video surveillance includes salon areas where beauty treatments are carried out, but we have underlined the type of activity carried out by the company. Lot of clients will live the experience at the salon as a private question, and not as a situation in which it is expected to be filmed.
The compensation is provided after a complex assessment, among other things, of the seriousness of the breach and finances of the company.
Waxing Palace AS has until the 20 of August for the appealation.
