SWEDISH SUPERVISORY AUTHORITY: bodycams of SL are against the law

The Swedish Data Protection Authority, IMY, has discovered that SL has breached the General Data Protection Regulation when ticket inspectors have been equipped with video cameras for bodies which register images and sounds. IMY emits an administrative sanction of 16.000.000 of SEK against SL.

The IMY, ex Swedish Data Protection Authority, has investigated on the usage by the SL of body-worn cameras. SL has adopted those tickets inspectors free form of video cameras. The purpose of video cameras is to prevent threatening situations, document accidents and ensure that the correct person has been sanctioned for having travelled on the public transport of Stockholm without a valid ticket.

Video cameras of ticket inspectors are continually registering images and sounds, which are stored for a minute, after that the material is deleted unless the data controller does not press the button of registration on the video camera. Ticket inspectors are educated to keep on the video camera during all their turn and shall register all the passengers who are moving on the inspector.

Different hundreds of thousands of people are travelling on the public transport system of Stockholm every day. Practically, this technology of continuous recording means that a big number of travelers are at risk to be motivated by video and audio registrations.

IMY believes that the technology of body-worn shall be used to prevent and document threatening situations, but the time of pre-registration shall be reduced to a maximum of 15 seconds. Anyway, the agency does not believe that the technology shall be used for guarantying the identity of a person which travels without a valid trip document; in this case, for example, it will be enough fixed images and any audio registration.

IMY criticizes also SL for not having provided adequate information on the video surveillance of video cameras, including the thing that not only images but also sounds are registered.

It is serious that SL does not inform the sound registration, since passengers of the SL network shall not wait to be register.

Deficiencies combined with the usage of body cameras by SL have bring IMY to issue an administrative sanction of 16.000.000 SEK.
