After a year of waiting since the expiring date of the actual Italian DPA, remained in office till now in the “prorogatio” regimen, tuesday 14 July 2020 the two parliament’s branches have elected the four new members that will be summits of the Italian DPA in the next 7 years.
The two members appointed by the Senato are Agostino Ghiglia (with 123 votes), ex journalist and ex-congressman, and jurist Pasquale Stanzione (with 121 votes), professor of private rights into the LAw Faculty in Salerno.
The Chamber of Deputies has elected the professor Ginevra Cerrina Feroni (with 209 votoes), professor of Italian constitutional law at the Faculty of Political Sciences in Firenze, and Guido Scorza (with 237 votes) cassation lawyer specialized in new technology right, privacy and intellectual property, known expert on the subject that the community of insiders of Federprivacy has been able to appreciate over the years for his contributions and his interventions at events organized by the main Italian professional association of professionals in the field of personal data protection.
Based on what is written into the article 153 of the Privacy Code, that requires a “proven track record in the field of personal data protection, with a particular focus on legal or it information technology”, is surely Scorza who has the best requirements to take up the position of Italian DPA president.
From the other hand, according to article 3 of the Regulation n. 1/2000 on the organization and operation of the Italian DPA, the new member of DPA elect their president with majority voting, “but in case of equality the ancient member will be the president”, and in this case is Pasquale Sanzione, born in 1945, who can be the president for the next 7 years of the Italian DPA.
