Stopping personal data transfer into the USA, the European Court of Justice invalids the Privacy Shield.

With the sentence in the lawsuit C-311/18 fo the 16 July 2020, the European Justice Court has invalidated the Privacy Shield, the widespread agreement with big organization and multinational can, till now, legitimate the personal data transfer from Europe and USA.

According to Court of Justice’s lawyers, the Privacy Shield does not offer to european citizen sufficient guarantee against the USA legislation on control and security of privacy, and that why according with GDPR the data transfer from UE to a third country can happen only in compliance with the principle “only if this third country guarantee an adequate protection level”.

If the invalidation of the Privacy Shield is like a victory for the privacy activists that accused since many years the USA for invasive practices and inadmissible surveillance on european citizens, the lawyers decision will create a lot of problems to USA and UE multinationals that make business on its own transfer and use of personal data. Companies like Facebook, Apple, Google and Amazon will have to think about new industrial strategies in order to be in compliance with the European Court of Justice’s decisions.
