In order to support public and private organizations that shall design drivers that have committed an infringement of the street code, the CNIL has adopted a new standard. Update the old legal framework (AU-10) that has not anymore a legal value since the entrance in force of the GDPR.
Supervision of the processing in the filed of the drivers designation
The owners of a drive license which has been published (rental agencies, delivery companies) receive reports in the event of infringement: in that case, they must designate the driver to the competent authorities.
This archive, adopted after a public consultation, permits to those organization to control the personal data processing about those designation in the respect of rights of data subjects.
Updated the Unique Authorization n. 10 which has not legal value on preliminary into the entrance in force of the General Data Protection Regulation (GDPR).
Purpose of the repository
The standard project aims to different purposes (objectives):
- the designation, the National Automated Processing Crimes Agency (ANTAI), of person who was driving or was probably that was driving the car at the time of the observation of the crime;
- the control of the procedure for the recovery of street code breaches for which public or private organization can be financial responsible;
- the production of anonymous statistic (statistical analysis on types of street infringements and sinister) in particular in order to adapt the formation of the street prevention.
Main changes to the repository
Contributions received by the CNIL during its public consultation have raised some questions and permitted to enrich the repository in order to better comply the exigences of interested organizations. Were provided details on:
- organizations interested into the legislation;
- data that can be recollected;
- reusage of data
- recipients
