DANISH SUPERVISORY AUTHORITY: EDPB adopts opinion on age verification

The European Data Protection Board (EDPB) has adopted an opinion on age assurance at its latest meeting.

At its meeting on 11 February 2025, the EDPB considered a wide range of matters. It was decided, among other things, to extend the task force previously set up by the Council to coordinate the enforcement activities of the European data protection authorities in relation to ChatGPT to cover the enforcement of AI more generally, including in the light of DeepSeek. In addition, an opinion on Age Assurance was adopted.

Several recent European regulations – including the GDPR – have focused on the protection of children and their rights in the digital world. The topic is also one of the EDPB’s focus areas, and the opinion on age verification aims to create a consistent approach to the topic across the EU.

Based on the rules in the GDPR, the statement provides guidance in the form of 10 principles that must be taken into account when personal data is processed for age verification purposes. The principles are all based on the GDPR’s basic rules for processing personal data to ensure that these are correctly implemented in the solutions that are developed.

Furthermore, work is continuing under the auspices of the EDPB on more comprehensive guidelines for the processing of children’s personal data, which will address the issue of age verification in more detail. This is work in which the Danish Data Protection Agency is actively participating.
