DANISH SUPERVISORY AUTHORITY: what is personal data protection?

Each person has the right to protect its personal data and anyone who processes personal data on other in a non-private contest it is obliged to respect those principles and to protect personal data. Those rights and obligations are joined together like “data protection”.

Any personal data processing of other person which does not occur under a private contest shall be carried out in the respect of the personal data protection legislation.

Personal information is all information relative to a natural person who is identifiable or identified.

The person who is processed is usually called the “data subject” meanwhile the person who processes personal data is the “data controller” or the “data processor”, depending on the role that he/she has in the processing.

The data subject has a series of rights against the data controller. The data subject rights shall be protected, the data controller and processor are responsible for this protection. Rights have the purposes of clarify to the data subject when and which personal information are processed.

The data controller shall guarantee that the processing of personal data is in compliance with a series of basic principles, as well as a legal basis for the processing. Legislations on personal data protection impose to the data controller to carry out a series of assessments and considerations on the protection of personal data processed.

When you, as a data subject, are questioning information on you or you calleth upon your rights against the data controller, the data controller shall response to your request. If the data controller does not do this or you are not satisfied of the response, you can contact the Danish Data Protection Agency, that can provide you additional information on you rights, including your opportunities to present a complainant.
