NORWEGIAN SUPERVISORY AUTHORITY: new guidelines of the European Data Protection Board for the consultation

The European Data Protection Board (EDPB) has published guidelines on the application of the article 65 to the public consultation. The same is applicable for additional indications on the assessment of certification criteria.

Guidelines for the usage of the article 65, paragraph 1, letter a)

The article 65, paragraph 1, letter a) of the Privacy Regulation is a mechanism for the resolution of controversial between personal data protection authorities in cases that involve cross borders procedures and guarantee the correct and uniform application of the regulations.

The guidelines aim to define the main phases of procedures of the proceeding and to clarify the competences of the European Data Protection Board when it adopts a legally binding rule pursuant to the article. The guideline includes also a description of procedures and applicable guarantees.

Those guidelines are applicable for the public consultation until the 28th of May 2021.

Guidelines on certification criteria

The guideline for the assessment of certification criteria is a supplement and shall be read pursuant to the other guidelines of the EDPB on the certification and on the detection of certification criteria according to article 42 and 43 of the Regulation.

The purpose of this guideline is to process elements of these guidelines. In addition, assist data subjects affected into the preparation of certification criteria, as well as Supervisory Authorities and the European Data Protection Board while providing uniform assessments in relation to the approval of certification criteria (both for national systems and European seals of privacy).

The guideline is available for the consultation until the 26th of May 2021.
