The Office of the Data Protection Commissioner announces that from 22/6/2021 it will begin to carry out checks on websites that use cookies.
As a reminder, cookies are small data files stored by a website on a visitor’s computer or mobile device. According to Article 99(5) of the 2004 Law on the Regulation of Electronic Communications and Postal Services (Law 112(I)/2004) and subsequent amendments, the use of cookies requires the consent of users.
The consent, by definition, should, inter alia, be explicit (and not implicit or implicit), given for specific purposes, free and revocable, obtained before the start of the processing and preceded by adequate information on the collection and processing of personal data. Withdrawing consent should be as easy as giving it.

Despite previous suggestions from my office (relevant notice of 30/07/2019), I note that a large number of websites have not yet implemented and/or fully implemented the relevant provisions.
