Positive opinion of the Italian Data Protection Authority the 9 of July 2020 on the draft decree which defines moods and terms of the “Mobility Coupon” supplied for the 2019 ad the discipline “Scrapping coupon”, provided by the relative experimental program in order to reduce pollutant emissions and in order to answer to climate changes. The mobility coupon is intended to adult over 18 years old inside of regional capitals, metropolitan Cities, provincial capitals and of Municipalities with population over than 50.000 inhabitants.
The draft decree – already submitted to the Italian DPA in March like a first version – has been modified by keeping in mind all the comments by the DPA during meetings and contacts with competent offices of the Ministry.
The comments of the DPA regards, in particular, web app access moods prepared by the Ministry, the presentation procedures of the demand by potential target, as well as the data verification by using the Public system of digital identity (SPID). Information on the control of the Program have been provided by the Ministry and, especially, on subjective responsibility compared to personal data process.
With some changes introduced, the scheme has resulted in compliance with the data protection discipline.
The Italian DPA thinks about an appropriate improvement of the text in the appeal to substitutive declarations part, which need to be made from the recipients at the time of the bonus request, in order to clarify, where it is possible, the mood and subjects from which the Ministry does the control of the existence of the requirements.
The “mobility coupon” will correspond to 60% of the expense incurred for the acquisition of bicycles, also with pedal assistance, and electrical vehicles, or for the use of services of shared mobility with individual use. The amount will not be over than 500 euros.
There will be also a “Scrapping Coupon”, required by the resident into Municipalities subjected to community infringement procedures for non-compliance with the obligations of the Air Quality Directive (2008/50/CE) also admitted in favour of cohabitants.
