PORTUGUESE SUPERVISORY AUTHORITY: CNPD PARTICIPATES IN THE EUROPEAN COORDINATED SUPERVISORY ACTION ON THE RIGHT TO DATA ERASURE

The CNPD announces its participation in the Coordinated Supervisory Action (CEF) of the European Data Protection Board (EDPB), which in 2025 will involve thirty-two Data Protection Authorities (DPAs) and has as its theme the right to erasure of data/right to be forgotten (article 17 of the GDPR).

The European Committee selected this topic during its October 2024 Plenary meeting because it is one of the most frequently exercised rights under the General Data Protection Regulation (GDPR), and about which DPAs receive numerous complaints from individuals.

In 2025, the CNPD, together with 31 (thirty-one) other DPAs, will investigate how data controllers implement and comply with the data subjects’ right to erasure , under the terms set out in Article 17 of the GDPR. This joint action involved the preparation of a detailed questionnaire on the procedures and practices of public and private organisations in relation to the right to erasure , which will be sent to data controllers.

Through this questionnaire, the DPAs will verify how data controllers handle and respond to the erasure requests they receive, paying particular attention to the conditions and exceptions for exercising this right.

The results of this initiative will be analysed in a coordinated and aggregated manner to provide an overview of the situation at European level, without prejudice to what each National Data Protection Authority may decide on the specific measures to be adopted at national level.

At the end, the CNPD will communicate to the EDPB the overall result of the action, including an assessment of the responses received, as a national contribution to the European report on the level of compliance with the GDPR with regard to the right to erasure , which will include general recommendations.

CEF 2025 is a key activity of the European Committee within the framework of its 2024-2027 Strategy, which aims to strengthen research and cooperation between DPAs.
